EFD-Reinf: Is Your Company Ready for This New Challenge?

What is EFD-Reinf?

EFD-Reinf is the new module of SPED, Brazil's Public Digital Bookkeeping System. It was through Normative Instruction No. 1701/17 that the Federal Revenue Service formally established the Digital Tax Bookkeeping of Withholdings and Other Tax Information — EFD-Reinf.

The new ancillary obligation will provide a detailed view of tax withholdings — INSS, IRRF, withheld CSLL, withheld PIS and COFINS — as well as registration information and administrative court proceedings.

This information will be delivered to the tax authorities in analytical form, impacting your company's Tax, Accounting, and Legal areas.

What will change with EFD-Reinf?

Once it becomes mandatory, it will replace the information requested in other ancillary obligations, such as the DIRF, the CPRB block of EFD Contribuições, and the DCTF — the latter replaced by DCTF WEB.

Which of these groups does your company fall into?

On December 15, 2017, RFB Normative Instruction No. 1767/2017 was published, setting the deadlines for the start of EFD-Reinf submissions:

  • GROUP 1: Companies with revenue above R$78 million in 2016: submission starting May 1, 2018 (transmit by June 15)
  • GROUP 2: Companies with revenue below R$78 million in 2016: submission starting November 1, 2018 (transmit by December 15)
  • GROUP 3: Public agencies: submission starting May 1, 2019 (transmit by June 15)

It is worth noting that EFD-Reinf must be transmitted to SPED monthly, by the 15th of the month following the one the bookkeeping refers to.

What are the penalties for failing to comply with the legal obligations covered by EFD-Reinf?

Companies that miss the EFD-Reinf submission deadline are subject to fines ranging from R$500.00 to R$1,500.00 per fraction or calendar month. In cases of omitted financial transactions or incomplete or inaccurate submissions, the penalty applied is 3% of the value of the corresponding financial transactions.
